1. Provider and Scope
These Terms of Service govern the use of the Paraglidingair app, the associated website and registration page, and all related features and services, hereinafter collectively referred to as the “Platform”.
These Terms of Service apply together with the Community Guidelines. The Community Guidelines supplement these Terms of Service and form part of the agreement governing the use of the community features.
2. Acceptance and Minimum Age
Acceptance of these Terms of Service and the Community Guidelines takes place during registration or before a membership is concluded, using the mandatory checkbox provided for this purpose.
Registration or the conclusion of a membership cannot be completed without this acceptance.
The Platform may only be used by persons who are at least 18 years old and legally capable of entering into the relevant agreement.
Anyone who does not agree to these Terms of Service or the Community Guidelines may not use the Platform.
3. Scope of Services
The Platform is intended for communication and networking within the paragliding community. In particular, it enables users to:
- create a user profile
- publish posts, comments, photos and videos
- exchange private messages
- follow other users
- share locations and paragliding-related information
- use additional community, mapping and communication features
4. Paragliding Safety
Paragliding involves significant risks. The Platform is intended solely for communication, networking and the provision of community content.
In particular, the Platform is not a substitute for:
- recognised flight training
- personal assessment of weather and flying conditions
- official weather, airspace or NOTAM information
- approved maps or navigation systems
- inspection of personal equipment
- required permits, insurance or qualifications
- emergency or rescue services
Locations and other paragliding-related information provided by users may be incomplete, outdated or inaccurate.
Each user is responsible for checking current conditions, local regulations, airspace restrictions, their own abilities and the equipment used.
Safety-related decisions must not be based solely on information obtained from the Platform.
5. Registration and User Account
Accurate and up-to-date information must be provided during registration. Profile information must not mislead other persons about the user’s identity.
As a general rule, each user may create only one personal user account. The user account may not be sold, transferred or made available for use by other persons.
Login credentials must be kept confidential and protected against access by third parties. Any suspected misuse or unauthorised access must be reported to us immediately.
Users are responsible for activities carried out through their user account to the extent that they caused such activities or enabled them by breaching their duty of care.
6. Community Guidelines
When using profiles, posts, comments, photos, videos, private messages and other community features, users must comply with the current Community Guidelines.
In particular, the Community Guidelines specify:
- which content and conduct are prohibited
- how content and users can be reported
- how users can be blocked
- how users can be unfollowed
- which moderation measures may be taken in the event of violations
Serious or repeated violations of the Community Guidelines may result in restrictions being placed on the user account or the user account being suspended.
7. User Content
Users generally retain all rights to the content they submit.
By uploading or publishing content, users grant us a non-exclusive, royalty-free and worldwide licence to perform the following technical operations with that content:
- store the content
- reproduce the content
- convert and optimise the content for different devices
- display the content within the Platform
- make the content available in accordance with the selected visibility and sharing settings
This licence is limited to the operation, security and provision of the Platform. To the extent technically necessary, corresponding rights may be granted to technical service providers engaged by us.
User content will not be used for external advertising or marketing without the additional consent of the user concerned.
As a general rule, the licence ends when the content or user account is deleted. This does not affect temporary backup copies or retention required by law.
Users confirm that they hold all necessary rights and consents for the content they publish.
8. Visibility of Content
Depending on the settings selected and the feature used, profile information, posts, comments, photos, videos, locations and other content may be visible to other members or through expressly shared links.
Users are responsible for checking, before publication, whether content contains personal, confidential or safety-related information.
Private messages are not publicly visible. However, they are technically processed through our systems and may be reviewed to the extent permitted by law if they have been reported or if this is necessary for security reasons or due to a legal obligation.
9. Location Features
The Platform may enable users to provide a location or share it with other users.
A location is determined or shared only as a result of an explicit action by the user and after the required device permission has been granted. No covert or default background location tracking takes place.
Within the available settings, users decide whether and with whom a location is shared.
Location information may be inaccurate or incomplete due to technical conditions and must not be used as the sole basis for safety-related decisions.
The locations of other persons must not be published or shared without their consent.
10. Following, Unfollowing and Blocking
Users may follow and unfollow other users. Unfollowing a user limits the display of that user’s future content in the unfollowing user’s own activity feed.
Users may block other users using the feature provided. Blocking restricts interaction between the user accounts involved within the scope of the technically available features.
Blocking or unfollowing a user does not automatically notify the moderation team of a possible violation.
In the event of harassment, threats or other violations of the Community Guidelines, the user or content concerned should also be reported using the reporting feature.
11. Reporting and Moderation
Prohibited content and conduct may be reported using the Platform’s reporting feature or by contacting us at support@paraglidingair.com.
We may review reported content and, depending on its severity, frequency and context, may in particular:
- remove content or restrict its visibility
- issue warnings
- temporarily restrict individual features
- temporarily or permanently suspend user accounts
- disclose information required by law to the competent authorities
Not every report will automatically result in the removal of content or the suspension of a user account. Reports will be reviewed in accordance with these Terms of Service, the Community Guidelines and applicable law.
To the extent required by law and without endangering other persons or ongoing investigations, we will inform the person concerned of the main reason for a measure and of any available opportunity to appeal.
In the event of immediate danger, the appropriate emergency, police or rescue service must be contacted instead of the Platform.
12. Paid Memberships
Where paid memberships are offered, the following information in particular will be displayed before the agreement is concluded:
- scope of services
- total price
- billing period
- contract term
- automatic renewal, if applicable
- cancellation options
- terms of any free trial period
The agreement is concluded once registration has been successfully completed and the membership has been confirmed or activated.
If automatic renewal applies, the membership will renew for the period specified at the time of conclusion unless it is cancelled in good time before the end of the current period.
Cancellation may be made using the method specified when the agreement was concluded. Access to paid features generally remains available until the end of the billing period already paid for.
Merely uninstalling the app does not terminate the user account or an active membership.
Any mandatory statutory rights of withdrawal and refund, as well as other consumer rights, remain fully unaffected.
13. Account Deletion and Termination
Users may delete their user account at any time using the feature provided or request deletion by contacting us at support@paraglidingair.com.
Deleting the user account does not automatically terminate an active membership or its automatic renewal. An active membership must therefore be cancelled through the membership account before the user account is deleted. Where deletion is requested, any active membership will be terminated before the user account is deleted.
Following deletion of the user account, personal data and content will be deleted or anonymised in accordance with our Privacy Policy, unless statutory retention obligations or legitimate reasons require temporary storage.
We may restrict or suspend a user account if:
- these Terms of Service or the Community Guidelines are seriously or repeatedly violated
- other persons or the security of the Platform are put at risk
- fraud or misuse is suspected
- a legal obligation requires us to do so
In the event of particularly serious violations, the user account may be suspended immediately. In other cases, a warning or an opportunity to respond should generally be provided first.
A suspended user may not circumvent the suspension by creating a new user account or using another person’s user account.
14. Rights to the Platform
The software, design, trademarks, logos, databases and content created by us for the Platform are legally protected.
Users are granted a personal, limited, revocable and non-transferable right to use the Platform as intended on their own devices.
Without our prior consent, it is prohibited in particular to:
- reproduce or commercially exploit the Platform or parts of it
- modify software components or create derivative works from them
- circumvent security or access restrictions
- extract data from the Platform using automated means
- reverse-engineer software components, except where expressly permitted by law
15. Third-Party Content and Services
The Platform may integrate maps, links, content or technical services provided by third parties.
We cannot guarantee their availability, completeness or accuracy. The use of external services may be subject to additional terms imposed by the respective providers.
We are not responsible for legal transactions that users enter into independently of the Platform with other users or external providers.
16. Availability and Changes to the Platform
We endeavour to operate the Platform reliably, but do not guarantee that it will be available, error-free or uninterrupted at all times.
Temporary restrictions may arise in particular due to maintenance, security measures, technical faults, force majeure or failures of external services.
If a prepaid service is permanently discontinued, we will refund the amount attributable to the period during which the service can no longer be used, unless an equivalent replacement service is offered.
17. Liability
We are liable in accordance with statutory provisions for damage caused intentionally or through gross negligence, and in all cases of mandatory statutory liability.
Liability for minor negligence is excluded to the extent permitted by law.
We do not guarantee the accuracy, timeliness or completeness of location information or other information provided by users or external providers.
Mandatory statutory claims and consumer rights remain unaffected.
18. Amendments to These Terms
We may amend these Terms of Service and the Community Guidelines if this is necessary due to legal requirements, security requirements, new features or the reasonable further development of the Platform.
Registered users will be informed of material changes in good time. Where required by law, renewed acceptance will be obtained.
If an amendment materially changes a paid membership to the user’s detriment, the membership may be terminated before the amendment takes effect.
19. Privacy
Information about the processing of personal data can be found in our separate Privacy Policy.
The Privacy Policy does not form part of these Terms of Service and does not have to be accepted as a contractual term. It must be easily accessible during registration and within the Platform.
Where necessary, voluntary consent for additional data processing, such as newsletters or optional marketing communications, will be obtained separately.
20. Governing Law and Jurisdiction
Swiss law applies, excluding its conflict-of-law rules, to the extent that such a choice of law is permitted by law.
Mandatory provisions protecting consumers, in particular those of the country in which they habitually reside, remain unaffected.
For users who use the Platform for business or professional purposes, the registered office of the provider is the exclusive place of jurisdiction. For consumers, the places of jurisdiction prescribed by law apply.
21. Final Provisions and Contact
If any provision of these Terms of Service is invalid or unenforceable, the remaining provisions will remain unaffected.
